Paternity

A Paternity action is a legal proceeding in which a parent of a child born out of wedlock seeks to establish the biological father as the legal father of the child. In an action to establish paternity, the court has the authority to also establish child support, timesharing, parental responsibility, as well as address nearly any other child related matter.

In the State of Florida an unwed mother has 100% timesharing rights with her child. What that means is although the biological father has standing to assert his rights associated with his child, until such an action is brought and an order establishing timesharing and parental responsibility is entered, the unwed mother has a claim superior to all others.
